DACA
The Deferred Action for Childhood Arrivals (DACA) program was introduced in 2012 by the Obama administration to provide temporary relief from deportation and work authorization for eligible undocumented individuals who were brought to the United States as children. DACA recipients, also known as Dreamers, are required to meet certain criteria, including continuous residency in the US since 2007, no felony convictions, and a high school diploma or equivalent.
If a person with DACA status is charged with a crime, they may face deportation, even if they have not been convicted. Therefore, it is crucial to seek the assistance of an experienced immigration attorney who can provide guidance and representation in criminal and immigration proceedings. Deandra Grant Law can assist those with DACA status who are charged with a crime in Texas.
An immigration attorney can help by:
- Providing legal advice and representation during criminal proceedings: An immigration attorney can advise a DACA recipient on the potential immigration consequences of a criminal charge and work to mitigate those consequences by negotiating plea agreements or pursuing alternative sentencing options.
- Representing DACA recipients in immigration court: If a DACA recipient is placed in removal proceedings, an immigration attorney can provide representation and advocacy in immigration court to fight deportation.
- Helping with DACA renewal and eligibility: An immigration attorney can assist with the renewal process for DACA recipients and can also advise on the eligibility requirements for DACA, which can change over time.
- Assisting with other immigration matters: An immigration attorney can provide assistance with other immigration matters, such as family-based petitions, naturalization, and asylum.
An immigration attorney can provide essential assistance to a DACA recipient charged with a crime, including legal advice and representation during criminal and immigration proceedings, representation in immigration court, assistance with DACA renewal and eligibility, and help with other immigration matters. Seeking the guidance and representation of an experienced immigration attorney can help protect a DACA recipient’s rights and provide the best chance for a favorable outcome in their case.
