As a non-citizen, a criminal conviction can have severe immigration consequences, including deportation, inadmissibility, and the denial of naturalization. It is essential to understand the potential consequences of a conviction before accepting any plea bargain or agreeing to a plea of guilty.
3. Know Your Rights
Non-citizens have the same constitutional rights as US citizens when facing criminal charges. This includes the right to remain silent, the right to an attorney, and the right to a fair trial. It is important to understand these rights and to exercise them throughout the criminal justice process.
4. Be Cautious of Plea Bargains
Plea bargains are often offered to criminal defendants in exchange for a reduced sentence or charges. However, non-citizens should be cautious when considering a plea bargain, as it may have immigration consequences. Before accepting a plea bargain, it is important to consult with an experienced criminal defense lawyer who can advise you on the potential immigration consequences.
5. Consider Alternative Sentencing
Alternative sentencing options may be available to non-citizens facing criminal charges. These options can help minimize the immigration consequences of a conviction. For example, a non-citizen may be able to participate in a rehabilitation program or community service in lieu of a prison sentence.
